What is an Apostille?

An Apostille (pronounced “ah-po-steel”) is a French word meaning certification. An Apostille is simply the name for a specialized certificate, issued by the Secretary of State. The Apostille is attached to your original document to verify it is legitimate and authentic so it will be accepted in one of the other countries who are members of the Hague Apostille Convention.

Bangladesh joined the Apostille Convention on July 29, 2024. 

What is an Attestation?

Attestation refers to the classic method of verifying the authenticity of a document by having a witness physically present when it is signed, who then also signs the document to confirm that they saw the signature being made, essentially acting as a guarantor of the document’s legitimacy; this is often associated with legal procedures like notarization where a notary public acts as the attesting witness.

Why do I need an Apostille/Attestation?

An Apostille/Attestation is required to authenticate documents for use in a foreign country that is a member of the Hague Apostille Convention. It verifies the authenticity of a public document so that it is recognized as legally valid abroad.

For countries not in this treaty, a different certification process called “Legalization” is used, typically involving consulates or embassies.

What is the difference between Apostille & Legalization?
An Apostille is a form of authentication issued to documents for use in countries that participate in the Hague Convention.
Whereas, there are several countries that do not participate in the Hague Convention. Still, the authentication process is similar which is called Legalization done by the Embassy or Consular Office of the country in which the document is to be used.

Is Bangladesh a member of Apostille Convention or not?

Yes, on 29 July 2024, the People’s Republic of Bangladesh deposited its instrument of accession to the Convention of 5 October 1961 Abolishing the Requirement of Legalisation for Foreign Public Documents (HCCH 1961 Apostille Convention). With the accession of Bangladesh, the 1961 Apostille Convention now has 127 Contracting Parties.

The Ministry of Foreign Affairs has been designated as the competent authority to issue apostilles in Bangladesh.

It takes around 3-5 work days to complete the whole MoFA Apostille process in Bangladesh.

What is the next step after MoFA Apostille done?

After obtaining an Apostille from the Ministry of Foreign Affairs (MoFA) in Bangladesh, the document is ready for use in any other member country of the Apostille Convention. Again, it is ready for further authentication process, also called as Double legalization or Superlegalization.
