Power of Attorney (PoA) Preparation
A Power of Attorney (PoA) is a written authorization to represent or act on another’s behalf in business or some other legal matter.
Power of Attorney documents are broadly categorized into:
- General Power of Attorney (irrevocable)
- Special power of Attorney (revocable)
Special Power of Attorney empowers the power receiver to carry out a specific legal transaction or to make the decision on a specific matter on behalf of the power giver such as collecting rent for a particular property.
Whereas, A Foreign Power of Attorney document authorizes one person (the recipient) to act on behalf of another person (the principal) for specific tasks or decisions. In the context of Bangladesh, it is a legal instrument used when the principal resides outside Bangladesh but needs someone in the country to manage affairs on their behalf. This is particularly common in situations involving property management, legal proceedings, or financial transactions.
The original and photo copy of Foreign Power of Attorney document must be attested by the MoFA, Bangladesh within 2 months from the date of signing at Bangladesh High Commission in abroad.
